All prices displayed on our Website are in United States Dollars (USD) and are subject to applicable sales tax as required by federal, state, and local law. We reserve the right to change prices at any time without prior notice. The price charged for your order will be the price in effect at the time your order is placed and confirmed.

We accept major credit cards, debit cards, and other payment methods as indicated at the time of checkout. By providing your payment information, you represent and warrant that: (i) the payment information you supply is true, correct, and complete; (ii) you are duly authorized to use the payment method; and (iii) charges incurred by you will be honored by your financial institution.

This confirmation does not guarantee that the order will be fulfilled if items are unavailable or if there is an error in pricing or product description. We reserve the right to cancel or refuse any order at our sole discretion. If we cancel your order, you will not be charged, or you will receive a full refund if your payment has already been processed.

6.3 Refunds and Returns

Due to the nature of food products, all sales are generally final once an order has been prepared. If you have a concern about the quality or accuracy of your order, please contact us at [email protected] within 24 hours of receiving your order, and we will work with you to resolve the issue in accordance with our customer satisfaction policies.

Gift cards are non-refundable, cannot be exchanged for cash (except where required by law), and are not transferable unless otherwise stated.   • Any content submitted by you through the Website;
  • Any fraudulent, negligent, or intentional misconduct by you.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses. You agree not to settle any such matter without our prior written consent.

10. Governing Law and Jurisdiction

These Terms of Service and any dispute or claim arising out of or related to them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which the relevant Anthony's Coal Fired Pizza location operates, without giving effect to any choice or conflict of law provisions.

These Terms are also subject to applicable federal laws, including but not limited to:

  • The Federal Trade Commission Act (FTC Act), 15 U.S.C. § 41 et seq., governing unfair or deceptive acts or practices in commerce;
  • The Computer Fraud and Abuse Act (CFAA), 18 U.S.C. § 1030, governing unauthorized access to computer systems;
  • The CAN-SPAM Act of 2003, governing commercial electronic communications;

  • For users in California: the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), governing the collection and use of personal information of California residents.

Any legal action or proceeding arising out of or relating to these Terms shall be instituted exclusively in the federal or state courts of competent jurisdiction in the United States, and you hereby consent to personal jurisdiction and venue in such courts. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

11. Dispute Resolution

11.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to attempt to resolve any dispute, claim, or controversy informally by contacting us at [email protected] and providing a written description of the dispute, the relief sought, and your contact information. We will attempt to respond within thirty (30) days of receipt. Both parties agree to negotiate in good faith to resolve the dispute before pursuing formal legal action.

11.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall be finally resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are incorporated herein by reference. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

The arbitration shall be conducted on an individual basis. YOU AND ANTHONY'S COAL FIRED PIZZA EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. You may only bring claims in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.

11.3 Time Limitation on Claims

Any cause of action or claim you may have arising out of or relating to these Terms of Service or the Website must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.

12. Term and Termination

These Terms of Service are effective as of the date you first access or use our Website and shall remain in full force and effect for as long as you continue to use the Website or Services, unless earlier terminated in accordance with these Terms.

12.1 Termination by You

You may terminate your account and your agreement to these Terms at any time by discontinuing use of the Website and, if applicable, requesting deletion of your account by contacting us at [email protected]. Termination of your account does not relieve you of any obligations incurred prior to termination.

12.2 Termination by Us

We reserve the right, in our sole discretion, to suspend or terminate your account and access to any or all Services at any time, with or without cause or notice, including but not limited to the following circumstances:

  • Your violation of any provision of these Terms;
  • Your conduct that we reasonably believe to be harmful to other users, the public, or us;
  • Your use of the Services in a fraudulent or unlawful manner;
  • Requests from law enforcement or government agencies;
  • Discontinuation or material modification of the Services.

12.3 Effect of Termination

Upon termination of your account or access to our Services, all licenses and rights granted to you under these Terms will immediately terminate. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to: Intellectual Property Rights, Disclaimers, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and Severability.

13. Changes to These Terms

We reserve the right to revise, amend, or update these Terms of Service at any time in our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this page. In some cases, we may provide additional notice of significant changes, such as by sending an email notification to the address associated with your account or by displaying a prominent notice on our Website.

Your continued use of the Website or Services after the posting of any revised Terms constitutes your binding acceptance of the updated Terms. If you do not agree to the updated Terms, you must immediately cease using the Website and Services. We encourage you to review these Terms periodically to stay informed of any updates.

No amendment to these Terms by you shall be effective unless explicitly agreed to in writing and signed by an authorized representative of Anthony's Coal Fired Pizza.

14. Allergen and Dietary Information

Anthony's Coal Fired Pizza takes food safety seriously. However, our kitchen handles a wide variety of ingredients, including common allergens such as wheat, gluten, dairy, eggs, nuts, soy, shellfish, and fish. We cannot guarantee that any menu item is entirely free from allergens or cross-contamination, as our food is prepared in a shared kitchen environment.

If you have a severe food allergy, intolerance, or other dietary restriction, we strongly encourage you to contact us directly before placing an order to discuss your specific needs. We disclaim all liability for any adverse reactions, health consequences, or damages arising from consumption of our food products, to the fullest extent permitted by applicable law.

Nutritional information, calorie counts, and ingredient lists provided on our Website are intended as general guidance only and may not reflect actual values due to variations in portion sizes, seasonal ingredient availability, and preparation methods.

15. Third-Party Services and Links

Our Website may contain links to or integrations with third-party websites, applications, services, and platforms, including but not limited to third-party delivery services, payment processors, reservation systems, and social media platforms. These third-party services are governed by their own terms of service and privacy policies, which you should review before using such services.

Anthony's Coal Fired Pizza does not endorse, control, or assume any responsibility for the content, privacy policies, practices, or terms of any third-party websites or services. We are not responsible for any damages or losses caused or alleged to be caused by your use of or reliance on any third-party services. Any transactions you enter into with third parties are solely between you and the applicable third party.

16. Privacy Policy

Your use of our Website and Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, store, and disclose your personal information. For users located in California, our Privacy Policy also addresses your rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to know, right to delete, right to correct, right to opt-out of the sale or sharing of personal information, and the right to non-discrimination.

By using our Services, you consent to our collection and use of your personal information as described in our Privacy Policy.

17. Force Majeure

Anthony's Coal Fired Pizza shall not be liable for any failure or delay in performance of its obligations under these Terms arising out of or related to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government actions or restrictions, labor disputes, civil unrest, war, terrorism, power failures, internet outages, supply chain disruptions, or any other event beyond our reasonable control ("Force Majeure Event"). We will make reasonable efforts to notify you of any Force Majeure Event and to resume Services as promptly as practicable.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by us on the Website, constitute the entire agreement between you and Anthony's Coal Fired Pizza with respect to your use of the Website and Services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the subject matter hereof.

No failure or delay by Anthony's Coal Fired Pizza in exercising any right, power, or privilege under these Terms will operate as a waiver thereof, nor will any single or partial exercise of any right, power, or privilege preclude any other or further exercise thereof or the exercise of any other right, power, or privilege.

19. Severability

If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, illegal, void, or unenforceable under applicable law, that provision shall be deemed severed from these Terms to the minimum extent necessary, and the remaining provisions of these Terms shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable, consistent with the original intent of the parties as expressed in these Terms.

The invalidity, illegality, or unenforceability of any particular provision of these Terms in any jurisdiction shall not affect the validity, legality, or enforceability of that provision in any other jurisdiction, or of the remaining provisions of these Terms in any jurisdiction.

20. Waiver

No waiver by Anthony's Coal Fired Pizza of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Anthony's Coal Fired Pizza to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

21. Assignment

You may not assign, transfer, delegate, or sublicense any of your rights or obligations under these Terms without our prior written consent. Any purported assignment without such consent shall be null and void. Anthony's Coal Fired Pizza may freely assign or transfer these Terms or any of its rights or obligations hereunder without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.
